Novitas Technology LLC ("Novitas Technology LLC," "we," "us," or "our") operates the EverAssist platform and the websites located at novitastechnology.us and everassist.pro, including all associated subdomains, funnel pages, client portals, and onboarding systems (collectively, the "Platform"). This Privacy Policy describes how Novitas Technology LLC collects, uses, stores, shares, and protects personal information obtained from visitors to the Platform, prospective clients, active subscribers, and any individual whose information is processed through the Platform in connection with a client's use of EverAssist services.
This Privacy Policy applies to:
Individuals who visit novitastechnology.us, everassist.pro, or any associated page
Individuals who submit information through any EverAssist onboarding form, checkout page, or contact form
Clients who subscribe to any EverAssist tier (Solopreneur, Momentum Edge, Authority Vault, Dominion OS)
Contacts of EverAssist clients whose information is uploaded to or processed through the Platform in connection with AI voice agent or SMS services
Affiliates enrolled in the Novitas Partner Alliance (NPA)
This Privacy Policy does not apply to third-party websites, services, or platforms that may be linked from the Platform. Novitas Technology LLC is not responsible for the privacy practices of any third party.
This Privacy Policy supersedes and replaces all prior versions of any Novitas Technology LLC privacy policy. The version of this Privacy Policy in effect at the time of your purchase or subscription renewal is the version that governs the processing of your personal information for that subscription period. Novitas Technology LLC maintains a version-controlled archive of all prior Privacy Policy versions, available upon written request to [email protected].
By accessing the Platform, submitting any information, or subscribing to any EverAssist service, you acknowledge that you have read and understood this Privacy Policy.

3. INFORMATION WE COLLECT
3.1 Information You Provide Directly
We collect personal information that you voluntarily provide when you:
Visit or register on any page of the Platform
Complete any onboarding survey, intake form, or client questionnaire
Purchase a subscription to any EverAssist tier
Submit a contact or support request
Enroll in or participate in the Novitas Partner Alliance affiliate program
Communicate with us by email or through any Platform messaging feature
Categories of personal information collected directly include:
Identity information: Full name, business name, title
Contact information: Email address, phone number, mailing address
Business information: Business entity type, EIN or tax identification number (collected for A2P 10DLC compliance purposes on applicable tiers), industry, website URL, social media handles
Financial information: Billing information submitted at checkout, processed exclusively through our authorized payment processor(s). Novitas Technology LLC does not store full payment card numbers on its own systems.
Account credentials: Username and password for client portal access
Communications: Content of any support requests, onboarding survey responses, or other direct communications you submit to us
Affiliate information: Referral links, commission records, and affiliate agreement execution data for NPA participants
3.2 Information Collected Automatically
When you visit the Platform, we and our technology service providers may automatically collect certain technical information, including:
IP address and approximate geographic location derived from IP address
Browser type, version, and settings
Device type and operating system
Pages visited, time spent on pages, and navigation path
Referring URL
Date and time of visits
Cookie identifiers and similar tracking data
This information is used for Platform security, performance optimization, fraud prevention, and analytics. It does not, on its own, identify you personally, but may be combined with other information we hold to do so.
3.3 Information Collected Through Checkout
The EverAssist checkout process, hosted within the Platform, captures the following at the time of purchase in addition to payment and identity information:
Timestamp of purchase
IP address of the purchasing device
Record of the mandatory policy agreement checkbox confirmation
The version of the Terms and Conditions and Privacy Policy in effect at the time of purchase
This checkout record constitutes the binding audit trail for your agreement to our Terms and Conditions, this Privacy Policy, and all incorporated policies.
3.4 Information Collected Through AI Voice Agent Interactions
The EverAssist platform includes AI voice agent services operated by Caden (outbound) and Reyna (inbound). In connection with these services:
Voice calls made or received through Caden and Reyna may be recorded, transcribed, and processed by the Platform and its underlying AI systems.
Call recordings and transcripts may be retained for quality assurance, compliance verification, and platform improvement purposes.
Individuals who interact with Caden or Reyna are communicating with an automated AI system, not a human representative.
The content of AI-generated voice communications is produced dynamically based on scripts, data, and configurations provided by the EverAssist client. Novitas Technology LLC does not review, pre-approve, or take responsibility for the specific content of any AI-generated communication delivered on a client's behalf. The client is solely responsible for the accuracy, legality, and appropriateness of all AI-generated content produced through their account.
NOTICE OF CALL RECORDING: Calls conducted through the EverAssist AI voice agent system may be recorded. By engaging with any AI voice agent deployed through the EverAssist platform, you consent to the recording and processing of that communication. If you do not consent to recording, you must notify the client whose campaign initiated the call and discontinue the call. EverAssist clients are solely responsible for providing any additional call recording disclosures required by the laws of the jurisdictions in which their contacts are located, including all applicable two-party or all-party consent states.
3.5 Information Uploaded by EverAssist Clients
EverAssist clients may upload contact lists, lead data, and other information about third parties to the Platform for use in AI voice agent and SMS campaigns. Novitas Technology LLC processes this data on behalf of the client as a service provider or data processor. The client is solely responsible for the lawful collection, accuracy, and compliance of any data they upload to the Platform. Novitas Technology LLC does not independently verify the accuracy or legal compliance of client-uploaded data.
Clients who upload third-party personal information to the Platform agree to defend, indemnify, and hold harmless Novitas Technology LLC from and against any claims, regulatory actions, fines, penalties, damages, and attorneys' fees arising out of or related to any allegation that the client's uploaded data was collected, processed, or used in violation of any applicable privacy, data protection, telemarketing, or consumer protection law.
4. HOW WE USE YOUR INFORMATION
Novitas Technology LLC uses personal information collected through the Platform for the following purposes:
4.1 Service Delivery
To process and fulfill your subscription to any EverAssist tier
To provision and operate AI voice agent and SMS services on your behalf
To administer your client account, including onboarding, go-live, and ongoing service delivery
To process payments through our authorized payment processor(s)
To administer affiliate enrollment and commission tracking for NPA participants
4.2 Communications
To send transactional emails, including purchase confirmations, onboarding instructions, trial period reminders, and account notices
To send service-related communications regarding changes to the Platform, updates to policies, or interruptions to service
To respond to support requests and inquiries submitted to [email protected]
To send marketing communications regarding Novitas Technology LLC products and services, where you have provided consent or where permitted by applicable law
4.3 Compliance and Legal Obligations
To maintain records required by applicable law, including A2P 10DLC registration records and checkout audit trails
To detect, investigate, and prevent fraud, unauthorized access, and other prohibited conduct
To respond to lawful requests from courts, regulatory agencies, and law enforcement authorities
To enforce our Terms and Conditions, this Privacy Policy, and all incorporated policies
To defend against legal claims and regulatory proceedings
4.4 Platform Improvement and Analytics
To analyze usage patterns and improve Platform functionality, content, and user experience
To conduct internal research and quality assurance on AI voice agent and SMS services
To generate aggregated, de-identified analytics that do not identify any individual
4.5 Business Transactions
In the event of a merger, acquisition, asset sale, restructuring, or similar business transaction involving Novitas Technology LLC, personal information held by Novitas Technology LLC may be transferred to the acquiring or successor entity as part of that transaction. We will provide notice of any such transfer that results in a material change to the terms under which your information is processed.
5. LEGAL BASIS FOR PROCESSING (APPLICABLE JURISDICTIONS)
For individuals located in jurisdictions that require a lawful basis for the processing of personal information, including California and states that have enacted comprehensive consumer privacy legislation that mirrors GDPR-equivalent standards, Novitas Technology LLC processes personal information on the following legal bases:
Contract performance: Processing necessary to deliver the EverAssist services you have purchased or to take steps at your request prior to entering into a subscription agreement
Legal obligation: Processing necessary to comply with applicable federal and state laws, including tax obligations, A2P 10DLC registration requirements, and records retention obligations
Legitimate interests: Processing for fraud prevention, Platform security, internal analytics, and enforcement of our policies, where those interests are not overridden by your rights and interests
Consent: Processing based on your affirmative consent, including consent to receive marketing communications and consent to call recording, where required by applicable law. You may withdraw consent at any time without affecting the lawfulness of processing that occurred prior to withdrawal. To withdraw consent to call recording, you must contact the EverAssist client whose campaign is contacting you, as Novitas Technology LLC does not control the initiation of individual client campaigns.
6. THIRD-PARTY DATA SHARING AND SERVICE PROVIDERS
6.1 Service Providers and Infrastructure Limitation of Liability
Novitas Technology LLC shares personal information with third-party service providers that assist in operating the Platform and delivering EverAssist services. These service providers are authorized to use your information only as necessary to provide services to Novitas Technology LLC and are contractually required to maintain appropriate confidentiality and security obligations.
The Platform operates on third-party infrastructure, including white-labeled CRM, automation, voice communication, and workflow platforms. Novitas Technology LLC implements commercially reasonable vendor security requirements but does not control the internal security architecture of its infrastructure providers. In the event of a data security incident originating at the infrastructure provider level — including but not limited to a breach, unauthorized access, or data loss event occurring within a third-party provider's systems — Novitas Technology LLC's liability is limited to the extent permitted by applicable law and as further defined in the Terms and Conditions. Novitas Technology LLC will provide required breach notifications in accordance with applicable law regardless of where the incident originates.
Categories of service providers include:
CRM and automation platforms: The Platform operates on a white-labeled CRM and marketing automation infrastructure. Contact data, campaign records, and onboarding information are stored and processed within this infrastructure.
AI voice and communication platforms: Voice agent services are powered by third-party AI communication platforms. Voice recordings, call logs, and transcripts may be processed and stored by these platforms in connection with service delivery.
SMS and messaging carriers: SMS messages sent through the Platform are transmitted through telecommunications carriers and messaging aggregators. Message content and recipient data are processed by these carriers in connection with delivery. Novitas Technology LLC is not responsible for carrier-level filtering, blocking, delays, or non-delivery of SMS messages.
Automation and workflow platforms: The Platform uses third-party workflow automation services to route data, trigger follow-up sequences, and manage onboarding workflows.
Payment processors: Payment transactions are processed exclusively by authorized third-party payment processors. Novitas Technology LLC does not store full payment card data on its own systems.
Email delivery services: Transactional and marketing emails are sent through third-party email delivery platforms.
Analytics providers: The Platform may use third-party analytics tools to collect and analyze usage data.
6.2 Affiliates
Contact information may be shared with registered affiliates of Novitas Technology LLC within the Novitas Partner Alliance to the extent necessary to administer affiliate referral relationships. NPA affiliates are prohibited from using shared contact information for any purpose other than the administration of their affiliate relationship with Novitas Technology LLC.
6.3 Legal Disclosures
We may disclose personal information to courts, regulatory agencies, law enforcement authorities, or other government bodies where we believe disclosure is required by applicable law, court order, or legal process, or where we believe disclosure is necessary to protect the rights, property, or safety of Novitas Technology LLC, our clients, or others. We will make reasonable efforts to notify you of such disclosures where permitted by law, but we are not obligated to do so in all circumstances.
6.4 No Sale of Personal Information
Novitas Technology LLC does not sell personal information to third parties for monetary or other valuable consideration. Novitas Technology LLC does not share personal information with third parties for those third parties' own independent marketing or advertising purposes without your consent.
6.5 SMS Opt-In Data
Novitas Technology LLC does not sell, rent, share, or disclose SMS opt-in data — including phone numbers, consent records, and opt-in timestamps — to any third party for marketing purposes. SMS opt-in data is used solely to deliver the communications you or your clients have consented to receive through the EverAssist platform and to maintain compliance records as required by applicable law and carrier requirements. This restriction applies regardless of any other data sharing provision in this Privacy Policy.
6.6 SMS Opt-Out — Applicable Tiers Only
SMS services are available exclusively on the Momentum Edge, Authority Vault, and Dominion OS subscription tiers. SMS is not available on the Solopreneur tier. All SMS opt-out rights and disclosures in this section apply only to individuals who receive SMS communications through a Momentum Edge, Authority Vault, or Dominion OS client account.
Recipients of SMS communications sent through the EverAssist platform may opt out at any time by replying STOP to any SMS message. Upon receipt of a STOP reply, no further SMS messages will be sent to that number except as required to confirm the opt-out. Standard message and data rates may apply. Message frequency varies based on the client's campaign configuration. For assistance, reply HELP or contact [email protected].
Novitas Technology LLC is not liable for SMS delivery failures, carrier filtering, message delays, or non-delivery resulting from actions taken by telecommunications carriers, aggregators, or network infrastructure outside the control of Novitas Technology LLC. Time-sensitive communications should not rely solely on SMS delivery through the EverAssist platform.
7. AI SYSTEMS — AUTOMATED PROCESSING DISCLOSURE
The EverAssist platform utilizes artificial intelligence systems to deliver voice agent communications, automated follow-up sequences, message generation, scheduling, and related functionality. The following disclosures apply to all AI-powered features of the Platform:
AI systems within the Platform do not make legally binding decisions on behalf of any user, client, or third party.
AI-generated communications are produced based on scripts, data inputs, and configuration parameters set by the EverAssist client. Novitas Technology LLC does not review or pre-approve the content of individual AI-generated communications. Clients retain sole responsibility for reviewing, overseeing, and ensuring the legal compliance of all AI-generated content produced through their accounts. AI systems may process personal information to generate contextually relevant responses. This processing is performed solely for service delivery purposes and is not used to make inferences about protected characteristics or for purposes unrelated to the delivery of EverAssist services. Novitas Technology LLC does not represent that AI-generated communications will be accurate, free of error, or appropriate for any particular purpose. Clients must implement their own review and quality assurance processes for AI-generated content before deploying it to their contacts.
7.1 Illinois Biometric Information Privacy Act (BIPA) Notice
The Illinois Biometric Information Privacy Act (740 ILCS 14/1 et seq.) ("BIPA") regulates the collection, storage, use, and disclosure of biometric identifiers and biometric information, including voiceprints and voice data derived from recordings used to identify an individual. AI voice agent services available through the EverAssist platform involve the recording and automated processing of voice communications. Depending on how a client's AI voice platform processes and analyzes those recordings, such processing may constitute the collection of biometric data under BIPA when the individual being contacted is located in Illinois.
EverAssist clients who use Caden or Reyna to contact individuals located in Illinois bear sole and exclusive responsibility for:
Determining whether their use of AI voice agent services triggers BIPA obligations with respect to their Illinois contacts
Obtaining any written release or informed consent required by BIPA prior to collecting, capturing, or otherwise obtaining biometric identifiers or biometric information from Illinois residents Maintaining a publicly available written policy establishing a retention schedule and guidelines for permanently destroying biometric data as required by BIPA Complying with all restrictions on the sale, lease, trade, profit, or disclosure of biometric data imposed by BIPA Ensuring that their AI voice platform vendor has executed a written data processing agreement that satisfies BIPA's third-party disclosure requirements
Novitas Technology LLC does not collect, store, or independently process voiceprints or biometric identifiers derived from voice recordings for the purpose of identifying individuals. Voice recordings retained by the Platform are retained for quality assurance, compliance verification, and dispute resolution purposes only. Notwithstanding the foregoing, EverAssist clients are solely responsible for assessing and ensuring their own BIPA compliance, and agree to defend, indemnify, and hold harmless Novitas Technology LLC from any BIPA claim, statutory damages award, class action, regulatory action, or enforcement proceeding arising from the client's use of AI voice agent services to contact Illinois residents. BIPA provides for statutory damages of $1,000 per negligent violation and $5,000 per intentional or reckless violation. Class action exposure under BIPA is significant. Novitas Technology LLC strongly recommends that clients who contact Illinois residents consult with qualified legal counsel experienced in BIPA compliance before deploying any AI voice agent campaign.
7.2 Evolving Regulatory Landscape — AI and Automated Communications
The legal and regulatory framework governing artificial intelligence, automated voice communications, AI-generated content, and consumer data practices is subject to active and ongoing development at the federal and state levels. As of the effective date of this Privacy Policy, regulatory proceedings relevant to the EverAssist platform include, without limitation, the Federal Trade Commission's commercial surveillance rulemaking, FCC proceedings regarding AI-generated voice calls and caller identification requirements, and state-level AI transparency and automated decision-making legislation enacted or pending in multiple jurisdictions.
Novitas Technology LLC is committed to monitoring material regulatory developments affecting the EverAssist platform and updating its policies, disclosures, and operational practices in response to final rules or enacted legislation that impose new obligations on the Platform or its clients. When material regulatory changes require updates to this Privacy Policy or to the TCPA Acceptable Use Policy, Novitas Technology LLC will update the relevant policy documents and notify active clients via email to the address on file.
EverAssist clients acknowledge that the regulatory environment governing AI voice agent and automated SMS communications is evolving, that compliance obligations may change during their subscription term, and that clients bear sole responsibility for monitoring and complying with any regulatory requirements applicable to their specific use of the Platform that are not expressly addressed by Novitas Technology LLC policy updates. Novitas Technology LLC does not represent that the EverAssist platform, as currently configured, will remain compliant with all future regulatory requirements without modification.
8. COOKIES AND TRACKING TECHNOLOGIES
The Platform uses cookies and similar tracking technologies to operate the Platform, recognize returning visitors, maintain session state, and collect analytics data. Categories of cookies used include:
Strictly necessary cookies: Required for the Platform to function. These cannot be disabled without impairing Platform functionality.
Analytics cookies: Used to collect aggregated information about how visitors use the Platform. This information is used to improve Platform performance and content.
Functional cookies: Used to remember your preferences and settings to improve your experience on the Platform.
You may configure your browser to refuse or delete cookies. Refusing cookies may limit your ability to access certain features of the Platform or may require you to re-enter login credentials. Novitas Technology LLC does not currently respond to browser Do Not Track signals, but we will update this policy if our practices change.
9. DATA RETENTION
Novitas Technology LLC retains personal information for as long as necessary to fulfill the purposes described in this Privacy Policy, to comply with applicable legal obligations, and to enforce our agreements. Specific retention periods include:
Active client records: Retained for the duration of the subscription plus a minimum of three (3) years following termination, to support audit trail requirements, chargeback defense, and compliance obligations
Checkout and policy agreement records: Retained indefinitely to satisfy E-SIGN Act and Terms audit trail requirements
A2P 10DLC registration records: Retained for the duration required by applicable carrier and regulatory requirements
Voice recordings and transcripts: Retained for a minimum of two (2) years unless a shorter period is required by applicable law or a longer period is required for legal defense purposes
Support communications: Retained for a minimum of two (2) years following resolution of the support request
Aggregated and de-identified data: May be retained indefinitely as it does not constitute personal information
10. DATA SECURITY AND LIMITATION OF LIABILITY
Novitas Technology LLC implements reasonable and appropriate technical and organizational security measures designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These measures include access controls, encrypted data transmission, and vendor security requirements.
No method of electronic transmission or storage is completely secure. Novitas Technology LLC does not guarantee the absolute security of personal information transmitted to or stored on the Platform. To the maximum extent permitted by applicable law, Novitas Technology LLC's total liability to any individual for any data security incident, unauthorized access, or data loss — whether arising in contract, tort, statute, or otherwise — shall not exceed the total subscription fees paid by that individual to Novitas Technology LLC in the three (3) months immediately preceding the incident giving rise to the claim. This limitation applies regardless of whether Novitas Technology LLC has been advised of the possibility of such damages and regardless of whether the incident originates within Novitas Technology LLC's own systems or within the systems of a third-party service provider. In the event of a data breach that triggers notification obligations under applicable law, Novitas Technology LLC will provide required notifications in accordance with those legal requirements.
11. YOUR PRIVACY RIGHTS
11.1 California Residents — California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA)
California residents have the following rights with respect to personal information Novitas Technology LLC holds about them:
Right to Know: The right to request disclosure of the categories and specific pieces of personal information Novitas Technology LLC has collected about you, the sources of that information, the business or commercial purposes for collecting it, and the categories of third parties with whom it has been shared.
Right to Delete: The right to request deletion of personal information Novitas Technology LLC holds about you, subject to applicable exceptions.
Right to Correct: The right to request correction of inaccurate personal information Novitas Technology LLC holds about you.
Right to Opt Out of Sale or Sharing: Novitas Technology LLC does not sell or share personal information for cross-context behavioral advertising. No opt-out action is required at this time.
Right to Limit Use of Sensitive Personal Information: To the extent Novitas Technology LLC processes sensitive personal information as defined under the CPRA, you have the right to limit that processing to purposes permitted by law.
Right to Non-Discrimination: Novitas Technology LLC will not discriminate against you for exercising any of your CCPA/CPRA rights.

11.2 Residents of Other States with Comprehensive Privacy Laws
Residents of Virginia, Colorado, Connecticut, Texas, and other states that have enacted comprehensive consumer privacy legislation may have rights substantially similar to those described above, including rights to access, correct, delete, and port personal information, and to opt out of certain processing activities. Regardless of your state of residence, you may:

Request deletion of personal information, subject to our legal retention obligations

Request information about the third parties with whom your information has been shared
We will respond to all verifiable privacy requests within the timeframe required by applicable law.
12. DISPUTE RESOLUTION
Any dispute, claim, or controversy arising out of or relating to this Privacy Policy, the collection or use of personal information by Novitas Technology LLC, or any alleged violation of any applicable privacy or data protection law shall be resolved in accordance with the dispute resolution and arbitration provisions set forth in the Novitas Technology LLC Terms and Conditions, which are incorporated herein by reference. By using the Platform and accepting this Privacy Policy, you agree that privacy-related disputes are subject to binding arbitration under the Terms and Conditions to the fullest extent permitted by applicable law.
Nothing in this section limits your right to submit a verified privacy rights request under applicable state law or to file a complaint with a state attorney general or applicable regulatory authority.
13. CHILDREN'S PRIVACY
The Platform is not directed to individuals under the age of 18. Novitas Technology LLC does not knowingly collect personal information from individuals under 18. If we become aware that we have collected personal information from a person under 18 without verifiable parental consent, we will take steps to delete that information promptly. 14. INTERNATIONAL DATA TRANSFERS
Novitas Technology LLC operates in the United States and stores personal information on systems located in the United States. If you access the Platform from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Platform, you consent to the transfer and processing of your information in the United States.
Novitas Technology LLC does not intentionally target residents of the European Union or European Economic Area. 15. THIRD-PARTY LINKS AND SERVICES

16. CHANGES TO THIS PRIVACY POLICY
Novitas Technology LLC reserves the right to update or modify this Privacy Policy at any time. When we make material changes to this Policy, we will update the "Last Updated" date at the top of this page and, where required by applicable law, provide additional notice to affected individuals. The updated Privacy Policy will be effective upon posting unless otherwise stated.
Each version of this Privacy Policy is archived and version-controlled. The version in effect at the time of your subscription purchase or most recent renewal governs the processing of your personal information for that subscription period. Your continued use of the Platform after any modification to this Privacy Policy constitutes your acceptance of the updated terms. If you do not agree to the updated Privacy Policy, you must discontinue use of the Platform and contact [email protected] to request account termination.
